Montenegro Court: Do Kwon to be released but still subject to travel restrictions
Terraform Labs founder Do Kwon's case in the Supreme Court of Montenegro seems to have taken a turn recently. According to a notice from the Montenegro court, the decision to extradite Do Kwon to South Korea has been postponed following the opposition statement filed by the Chief Prosecutor on Thursday. Plot Twist in Do Kwon's Case
Earlier this month, the Supreme Court of Montenegro ruled to extradite Do Kwon to South Korea, and this decision was considered final, leading many to believe that Montenegro's involvement in Do Kwon's case had come to an end.
Do Kwon could be extradited back to South Korea as early as this weekend. Will the U.S. and South Korea cooperate in the trial?
Delay in Extradition to South Korea
However, the Montenegrin Chief Prosecutor's Office issued a statement on Thursday this week opposing the Supreme Court's decision regarding Do Kwon, stating that the Supreme Court's ruling did not follow standard procedures but rather simplified the process and overstepped its authority. The decision on extradition should be made by the Ministry of Justice, and the Supreme Court of Montenegro has violated regulations.
Another reason cited was that the court did not consider the opinion of the Supreme State Prosecutor's Office during the appeal process, which violates the provisions of the International Legal Assistance in Criminal Matters Act and the Criminal Procedure Act. This contravenes the provisions of criminal procedure and affects the court's judgment.
Due to these reasons, the Montenegrin Chief Prosecutor's Office has requested protection of the legality of the extradition, suggesting that the Supreme Court confirm the validity of the protection request and change its decision until the Ministry of Justice makes a determination.
As a result, the Supreme Court of Montenegro has taken action to delay the extradition of Do Kwon to South Korea and stated that it will wait for a decision from the Ministry of Justice before executing the ruling.
Do Kwon to be Released
Do Kwon is set to be released this Saturday, again pending a new decision from the Ministry of Justice. However, due to facing charges from the International Criminal Court, the Supreme Court of Montenegro has ordered the confiscation of Do Kwon's passport to restrict his exit from the country.
