According to the document submitted by the prosecutor to the court, they requested to add two bail conditions for SBF:

  1. SBF is not allowed to contact or communicate with current or former employees of FTX or Alameda without the presence of a lawyer, unless exempted by the government or the court.

  2. SBF is prohibited from using any encrypted communication software, including but not limited to Signal.

The prosecutor pointed out that on January 15 of this year, SBF contacted a key witness, Ryne Miller, FTX US General Counsel, via email and Signal:

I am very eager to reconnect with you to see if there is a way for us to have a more positive relationship, potentially share resources where possible, or at least compare notes on what we know.

The prosecutor believes that SBF's actions were an attempt to influence Ryne Miller's potential testimony, suggesting that they should coordinate their testimonies for consistency, and instructing Ryne Miller to liquidate Alameda's venture investments and transfer them to FTX US to fill the funding gap.

He emphasized that SBF's public insistence on FTX US's full solvency is absurd. He also mentioned that the daily conversations between former employees of FTX and Alameda were conducted on Slack and Signal, with a mechanism set to automatically delete messages within 30 days, significantly complicating the investigation for the prosecution.

In conclusion, the prosecutor believes that adding bail conditions is very reasonable.
